This is BS...

Our realtor stopped by today with the most recent updates on the contract with the buyer that backed out. And the long and short of it is that if we opt to keep the deposit (which is used to make a contract binding) then our house must stay in the "under contract" status until after
4-25-05 (which was our original closing date) and even then we may not get the deposit (I guess that option would be more for principle purposes), plus like our realtor said, if a house has this particular staus no one will even bother looking at it. If we had the time to fight for the deposit check we may have looked at it as an option, but we closed today on our new house and need this house to be SOLD!

So we signed over a form that states that the contract was null and void based on the home inspection (which really is not the case), but now our house can officially be on the market.

What I am learning from this entire experience is why should you work hard to have good credit, and live honestly, when it just seems to be so much easier to lie about what you have cause then you can get out of contracts with nothing lost on your part and get your money back. This lady knew we needed to sell, and she took advantage of that situation, we lost a week of possible showings because we thought our home was "SOLD" and now we will have to find a way to not only pay our current mortgage but also the new one starting in May, plus I will not be able to cut off the water or electric in the house and I will have to continue to pay HOA dues until someone else moves in! Thank goodness I know how to live cheap because these next few months will be a real test of that!

OK, enough gripping...I need to get back to packing boxes...AHHH!
